News of Ukraine: the Verkhovna Rada of Ukraine approved in the second reading the bill No. 8068 “On national security”.

The Verkhovna Rada of Ukraine adopted in the second reading and the whole presidential bill (No. 8068) on the national security of Ukraine. For the law voted 248 deputies at the plenary session of Parliament on Thursday.

The document defines and delimits the powers of state bodies in the sphere of national security and defense. According to the law, the fundamental national interests are, including Ukraine’s integration into the European space in different areas, gaining membership in the European Union and NATO.

The law establishes that the sector of security and defense of the country is subject to democratic civilian control . In the Verkhovna Rada may be created by the Committee, the authority of which is controlrole activities of special purpose bodies with law enforcement functions, law enforcement and intelligence.

The document describes how each will be coordinated and subject to different links of the security forces and defense.

The structure of the defence sector

The President – the commander in chief. He declares war and enters the military or state of emergency, decides on General or partial mobilization, issues orders, directives on defense, chairs the Council of national security and defence, appoints and dismisses the Secretary of the national security Council and his deputies, appoints/dismisses the high command of the APU (on the recommendations of the commander-in-chief) and so on.

In the editorial to the first reading means that the national security Council may invite the President to establish the headquarters of the Supreme commander. Then the Bet was replaced by the “higher collective strategic leadership on the military defence of the state.”

The Ministry of defence is the Executive authority and military control. Subordinate to this Ministry, armed forces and State special transport service. The defense Minister, the President appoints from among civilians. The Minister of defence submits to the President as commander in chief and accountable to the Verkhovna Rada. At his office, he is part of the national security Council.

The head of the armed forces – the chief of the APU. He shall be appointed on the proposal of the Minister of defense and dismissed by the President (subject to them both).

The APU is the General staff, which during the special period leads the armed forces and other defence components. At the head of a different person – the chief of the General staff of lying. He is subordinate to the chief of the APU.

In parallel with the General staff of VSU works Operational headquarters, headed by the commander of the joint forces (he is also subject to the chief of the APU).

The national guard is a military formation with law enforcement functions. In peacetime, the national guard play the role of law enforcement officers, but are trained to work in the defence forces. With the introduction of martial law the National guard was transferred to the defence force.

Management

According to the wording of the second reading of the SBU is not only subordinate to only the President, but controlled by Parliament. From the law “On the security service of Ukraine” seized the norms on the powers of the SBU to combat corruption.

If you had transferred to the intelligence bodies of Ukraine, the final version is given only a General definition: “the organs or departments authorized to carry out intelligence activities for the protection of national interests of Ukraine from external threats.”

Turchynov and Ukraine’s membership in NATO: Not in the near future

It also secured the legal basis and principles of state policy in the sphere of national security and defense, the fundamental national interests of Ukraine, including state sovereignty and territorial integrity, Ukraine’s integration into European political, economic, legal space of EU membership and NATO.
