Chief military Prosecutor General Prosecutor’s office is conducting an investigation on the fact of mass granting of Hungarian, Romanian, Polish and Russian passports to residents of the Western regions of Ukraine and the temporarily occupied territories of Donetsk and Lugansk regions.
According to the materials of the proceedings, the Chief military Prosecutor General Prosecutor’s office performs procedural management in the pre-trial investigation in criminal proceedings from June 3, 2019, which is conducted the Main investigation Department of the security Service of Ukraine according to part 1 of article 14 of part 2 of article 110 of the criminal code on the fact of preparation of the encroachment on the territorial integrity of Ukraine, according to preliminary arrangement by group of persons, combined with inciting ethnic hatred.
In particular, he studies the information about the mass issuance of passports of citizens of Hungary, Romania, Poland and Russia, respectively, residents of the Western regions of Ukraine and the temporarily occupied territories of Donetsk and Lugansk regions, “which can further threaten the territorial integrity and sovereignty of Ukraine by strengthening the autonomist and separatist sentiment among compatriots (the creation of national-territorial autonomy on a national basis, individual polling districts in places of compact residence of ethnic citizens, education in minority languages, etc.)”, explained in the materials.
However, as stated in the document, the investigation has become necessary to obtain temporary access to documents of the office of the Council of national security and defense Council (NSDC), which contains information about the mass issuance of passports and “about the planned measures to eliminate such real or potential threats.”
In accordance with the decision, September 26 the Pechersky district court of Kyiv allowed the Prosecutor General to the national security Council the necessary documentation for the period from 07 APR 2014 to September 26, 2019.
So, the investigators of the military Prosecutor will be able to access incoming and outgoing documents, which were received from Main intelligence Directorate of the defense Ministry, State border service, the foreign intelligence Service, the security Service of Ukraine, Ministry of internal Affairs (National police) and other government agencies with information about the mass issuance of passports of citizens of Hungary, Romania, Poland and Russia.
Access is also open to documents of the national security Council were sent to the Office of the President, the Cabinet of Ministers and Central Executive authorities and law enforcement agencies, as well as transcripts of national security Council meetings in 2014 and written decisions.
The court’s decision is valid for 30 days from the date of adoption and cannot be appealed.
In case of default of the decision of the court, may require the decision to conduct a search in the national security Council.
