The district administrative court of Kiev in support of the claim of OOO “Ukrdorinvest” has forbidden the state property Fund (SPF) to perform any actions on privatization of JSC “Centrenergo”.
As indicated in the court ruling of 22 may, the measure taken at the request of plaintiff, entered may 22, “Ukrdorinvest”.
The company asked the court to declare illegal its rejection by the Fund to participate in the tender for privatization of 78,289% of shares of PJSC “Centrenergo” and to cancel the relevant paragraph of the order of the SPF from 10 December 2018.
In definition of court from may 22, it is noted that the manufacturing claim “Ukrdorinvest” to the SPF opened may 16, 2019 (in the court ruling incorrectly specified 2018 – if), the proceedings in summary procedure was scheduled for September 5, 2019. But given the additional requirements of “Ukrdorinvest” the court has decided to accelerate the trial and postponed the hearing to an earlier date is 13 June 2019.
As reported, the state property Fund in April said it may announce a repeated tender for the sale of 78,289% of shares of PJSC “Centrenergo” may 16, 2019. This was evidenced by the data in the accompanying documents to the draft adopted by the government at the meeting on Wednesday orders to extend the placement of shares of PJSC until September 30, 2019, the text of which has “Interfax-Ukraine”.
SPF 29 October 2018 announced a tender for the sale 78,289% of shares of PJSC “Centrenergo” at a starting price of 5 billion 984,992 million. The sale was scheduled for 11:00 on 13 December 2018. The contest was to be held in the presence of at least two members, one of which is foreign.
After the competition’s original intention to participate in it said the six companies, of which the documents with the financial guarantee, according to Agency data, was filed by OOO “Ukrdorinvest” (Kiev), the beneficiary of which is businessman Vitaly Kropachev, and Belarusian unitary enterprise Neftebitumen plant, owned by the largest private Belarusian oil-trader “Interservice”.
However, the acting head of the SPF Vitaly Trebarov on December 11 reported that the competition will not take place, as both of these contenders are not allowed to participate because the submitted documentation does not meet the requirements of the legislation.
Centrenergo operates 23 block (18 – coal-fired, five gas-oil) on vuglegirska, zmiivska and Trypilska TPPs with total installed capacity of 7690 MW.
The results of operations in 2018 “Centrenergo” has reduced net profit by 3.8 times (1 billion 391,936 million UAH) compared to 2017 year – to 499,127 million.
